Terms & Conditions

Please read these terms and conditions carefully before using Our Service. These Terms constitute a legally binding agreement between You and Ibrandium Sdn. Bhd.

1. Interpretation and Definitions

1.1 Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

1.2 Definitions

For the purposes of these Terms and Conditions:

  • Company (referred to as either “the Company”, “We”, “Us” or “Our”) refers to Ibrandium Sdn. Bhd., Malaysia.

  • IBTech refers to the proprietary whitelabeled software platform and AI Chatbot environment provided by the Company.

  • Service refers to the Website, IBTech platform, Creative AI services (voice, image, and video generation), and n8n-based automation systems developed or provided by the Company.

  • AI Output refers to any text, voice, image, or video generated by the Company’s AI tools upon Your request.

  • Website refers to Ibrandium, accessible from ibrandium.com.

  • You means the individual or legal entity accessing the Service.

2. Acknowledgement

These Terms set out the rights and obligations of all users regarding the use of the Service. Your access is conditioned on your acceptance of these Terms and our Privacy Policy, which complies with the Malaysian Personal Data Protection Act (PDPA) 2010.

3. Specific Service Disclaimers

3.1 Creative AI (Voice, Image, Video)

You acknowledge that AI-generated content is produced via machine learning algorithms. The Company does not guarantee the uniqueness, accuracy, or copyrightability of AI Output. We are not liable for any similarities between AI Output and existing copyrighted works.

3.2 AI Chatbots (IBTech)

The IBTech Chatbots utilise artificial intelligence to simulate conversation. You acknowledge that AI can “hallucinate” or provide incorrect, biased, or inappropriate information. The Company is not responsible for any decisions made or actions taken based on AI Chatbot responses.

3.3 Automations (n8n & Third-Party APIs)

Automation systems (built via n8n or similar) rely on third-party APIs (e.g., Google, Meta, OpenAI). You acknowledge that these automations may cease to function or “break” if third-party providers change their API structures, terms, or access. The Company is not liable for data loss or business interruption caused by such external changes.

3.4 Platform Availability (IBTech)

While we strive for 99% uptime, IBTech is hosted on third-party infrastructure. We are not liable for service outages, data breaches, or performance degradation caused by the underlying host provider.

4. Intellectual Property Rights

4.1 Company Property

The Service, its original code, the IBTech interface, and automation logic remain the exclusive property of Ibrandium Sdn. Bhd. and its licensors.

4.2 Use of Deliverables

Subject to full payment of fees, you are granted a license to use the AI Output and automations for your business purposes. You may not reverse-engineer the IBTech platform or the underlying n8n automation workflows provided as a service.

5. User Conduct & Prohibited Activities

You agree not to use the Service to:

  • Generate “Deepfakes” or deceptive AI content intended to defame or mislead.

  • Use AI Voice generation to impersonate individuals without their express consent.

  • Violate Malaysian Cyberlaws or the Communications and Multimedia Act 1998.

  • Attempt to “jailbreak” or prompt-inject AI Chatbots to bypass safety filters.

6. Payments, Subscriptions, and Refunds

  • Billing: IBTech is provided on a subscription basis. Failure to pay will result in immediate suspension of access to the platform and all active automations.

  • Changes: We reserve the right to adjust pricing with 30 days’ notice.

  • Refunds: Due to the computational costs associated with AI generation and software licensing, payments are generally non-refundable unless otherwise stated in a separate Service Level Agreement (SLA).

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY MALAYSIAN LAW, IBRANDIUM SDN. BHD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

This includes, but is not limited to:

  • Loss of profits or revenue resulting from automation failures.

  • Reputational damage caused by AI-generated content.

  • Errors or inaccuracies in AI Chatbot advice.

Our total liability for any claim shall be limited to the amount actually paid by You to the Company in the three (3) months preceding the event giving rise to the claim, or 100 USD (equivalent in MYR), whichever is lower.

8. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS.” We make no warranty that the AI services will meet your specific requirements or that the results will be 100% accurate.

9. Governing Law

The laws of Malaysia shall govern these Terms. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Termination

We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or if your use of AI tools poses a legal risk to the Company.
